These Terms and Conditions ("Terms") govern purchases made from Sour Nectar Pty Ltd (ABN 47690789523) ("Sour Nectar", "we", "us", "our") via our website at sournectar.com.au. By placing an order with us, you agree to be bound by these Terms — please read them before you order. If you buy our products through a stockist or at a market, Section 9 explains how that's handled.
Nothing in these Terms excludes, restricts, or modifies any guarantee, condition, warranty, right, or remedy given to you under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded.
Our goods come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure, and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
If any clause in these Terms is inconsistent with a right you hold under the ACL, that clause applies only to the extent the law allows — your ACL rights always prevail.
Placing an order is an offer by you to purchase the products in your cart. Receiving an order confirmation email doesn't mean we've accepted your order — a contract of sale is only formed once we dispatch it.
We reserve the right to refuse or cancel an order at any time, including where a product is unexpectedly out of stock, where we suspect fraud, or where a pricing or listing error has occurred. If we cancel your order, you'll be refunded in full.
To the maximum extent permitted by law, and always subject to your non-excludable rights under the Australian Consumer Law described in Section 1, our liability to you for loss or damage arising from your use of our website or purchase of our products is limited to, at our option, the replacement, or resupply of the goods, or the cost of doing so. We are not liable for any indirect, special, or consequential loss arising from your use of our products or website.
These Terms apply to purchases made directly through sournectar.com.au. If you buy Sour Nectar products from one of our retail stockists, or at a market stall operated by someone else, that purchase is governed by their own terms and returns policy — please direct any purchase-related query to them first. Your consumer guarantees under the ACL apply no matter where you buy our products.
If you buy directly from us in person at a market we're attending, payment and any on-the-spot exchange is handled at the time of sale; our online returns process in Section 2 applies to online orders only.
By submitting a review, photo, or other content to us — including via our website review form — you grant Sour Nectar a non-exclusive, royalty-free, worldwide licence to reproduce, publish, and display that content on our website and marketing channels. You confirm any content you submit is your own, accurate, and doesn't infringe anyone else's rights. We may edit, decline to publish, or remove submitted content at our discretion, including reviews that are offensive, unrelated to the product, or that we reasonably believe to be fake.
All content on this website — including text, recipes, photography, logos, and design — is owned by or licensed to Sour Nectar and protected by copyright and other intellectual property laws. You may not reproduce, distribute, or commercially use any of our content without our prior written permission.
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales for any dispute arising from these Terms.
